Title	Institutionalizing Public Deliberation in Legislative Design: Comparative Models from Asian Constitutional Systems
Abstract	This paper explores the public deliberation in the law-making process within the Asian constitutional systems. Most Asian jurisdictions have the consultation provisions in the legislations, however, it ranges about symbolic consultation. This paper examines the design of the institutions in the Asian countries, such as Indonesia, South Korea, Taiwan, Japan, and India, identifies the structural features that enable public deliberation to move beyond procedural formality and become an integral part of democratic governance. This research was conducted using a study method on documents related to the constitutional system of legislation, and conducting a comparative study of these regulations in several countries.This paper examines the public consultation within the scope of the constitutional provisions, the institutional design, and the ways democracy is exercised by way of the public. The study puts participatory innovation to the forefront: the use of forums for consultation, the use of digital tools to facilitate civic activism, the use of mechanisms and structures of the public administration going out of the governmental processes, the use of impact assessments of regulations to facilitate public participation, collaborative approaches to work with the public, and especially the marginalized. The study examines the paradox of efficiency of the operative law-making and the constitutional law of (normative) public consultation, a paradox of the rapidly developing Asian countries. The paper depicts the public consultation to the participation of the public to be the bedrock of democracy, the law and of the social bond which will pave the way for Asia to be a highly interlinked world. The findings highlight emerging models of best practice while offering a conceptual framework for states seeking to deepen participatory constitutionalism. Ultimately, this paper contributes to the broader discourse on how Asian democracies can cultivate inclusive, knowledge-rich, and future-oriented lawmaking processes.
Biography	Yustina Niken Sharaningtyas. I am a lecturer at the Faculty of Law, Universitas Atma Jaya Yogyakarta, assigned to teach Constitutional Law, Central Government Law, State Science, Legislation, and Human Rights Law. Active in regional, national, and international seminars. I completed my undergraduate studies with a full scholarship from the Faculty of Law, Atma Jaya University, and graduated in 2004 as the best graduate with cum laude honors. I completed my Master's degree at the Master of Law, University of Indonesia (UI), and graduated with cum laude honors. I have been actively conducting research, and in the last 10 years I have conducted 18 research projects with 21 publications related to constitutional law, constitutional law, law and society. I am currently pursuing my Doctoral Program in Law (2025) at the Faculty of Law, University of Indonesia. SCOPUS ID 59747692500, SINTA ID 5976098. Satya Arinanto. I am a full-time professor at the Faculty of Law, Universitas Indonesia, earning a Bachelor of Laws, Master of Laws, and Doctor of Laws from the Faculty of Law, University of Indonesia. I have attended Advanced Education in International Human Rights Law at the University of Notre Dame, Indiana, United States of America (USA) on a scholarship from The Ford Foundation. I was a Fulbright Scholar on the U.S. Constitution (May-August 2001) in the United States.
