Title
The legal safeguards for climate change litigation
Abstract
Climate issues are closely related to the survival and development of humanity. In response to the severe challenges posed by climate security and climate change, the international community has placed great emphasis on climate change. After the signing of the Paris Agreement, the importance of climate security governance has become increasingly evident, with a growing number of climate-related lawsuits worldwide. Countries have responded through different dimensions of litigation, focusing on both the protection of subjective rights and the maintenance of objective order. Under the strong impetus of the "dual-carbon" goals, this paper draws on the legislative experiences of other countries to analyze the challenges and issues inherent in the legal and policy framework concerning climate security and governance. It further explores ways to enhance multi-stakeholder cooperation in governance, reinforce the judiciary's role in climate litigation, and foster international collaboration to tackle climate challenges.These measures aim to establish solid legal foundations for ensuring effective climate security governance.
Biography
Zhang Ruiping is a professor at Gansu University of Political Science and Law, holding a Bachelor's degree in Law, a Master's degree in Law, and a Doctorate in Economics. She is engaged in teaching and research work in Environmental and Resource Protection Law and Environmental Economics, and serves as the Dean of the Environmental Law School at Gansu University of Political Science and Law. She is a leading talent in Gansu Province, a "Feitian Scholar" of Gansu Province, and a "Longyuan Young Talent" of Gansu Province. She has presided over and completed more than 20 national social science fund projects, provincial and ministerial, as well as local government research projects; and has completed 8 research reports and think tank projects. She has published more than 50 academic papers.She has received numerous awards and honorary titles.
