The Lawsuit Dilemma and Measures of automatic vehicle Infringement: From the perspective of automobile enterprises
Abstract
In recent years, with the development and promotion of driving automation technology, the scale and frequency of intelligent connected vehicles on the road have been continuously expanding. However, car companies that rely on this emerging technology for production and operation are facing litigation difficulties. Product liability, motor vehicle traffic accident liability, and breach of contract liability are the three main types of litigation. Whether they meet technical standards, belong to the motor vehicle side, and constitute fraud are the main challenges faced by car companies. This article proposes a unified defect judgment standard, clarifies the concept of motor vehicles, defines the connotation and extension of fraud, and provides specific solutions for other common litigation dilemmas, in order to provide useful ideas for car companies to avoid the risk of losing lawsuits.
