Intersection of AI with Copyright Laws: Legal Uncertanties and Way Forward
Abstract
Artificial Intelligence (AI) is impacting all fields of human endevour today, and this in turn is posing novel problems for legislatures and legal professionals. One such area of concern is its intersection with copyright laws. Authors world around are worried that AI could replace them as it can create music, write articles, create artistic works and what not. On the other hand AI is challenging the traditional notions of copyright law in regard to Authorship, rights, accountability etc. AI industries also fear copyright laws as they need protected work to train their AI systems. A good AI system requires access to the available data. Different Jurisdictions in Asian region have amended their copyright legislations to deal with the novel issues created by the development and use of Artificial Intelligence. While there are few countries like Japan and Singapore who have gone in favour of AI industries. Singapore has created an computational analysis exception via Copyright Amendment Act 2021. Japan has also issues white papers which aim to make Japan a AI friendly country. While a few jurisdictions in Asia have not taken any clear stand in relation to AI while a few countries in Asia focus on respecting the rights of the Authors and at the same time promoting AI for economic benifits. India has also recently appointed a committee to suggest changes in the Indian Copyright Act to deal with the challenges posed by the AI. This paper aims to study the laws of 4 Asian Countries including Asia, Japan, India and china to find out how they have adapted their copyright laws to meet the challenges posed by AI and try to find out what these countries can learn from each other. Also this paper aims to find out the approach that not only promotes Artificial Intelligence but also protects the rights and respect of the authors which in turn leads to the empowerment of all Asian Countries
Biography
The author is presently serving as an Assistant Professor in Faculty of Law, University of Delhi. She has completed her LL.M for USLLS, Guru Gobind Singh Indraprastha University, Delhi and Ph.D. in copyright laws from the Faculty of Law, University of Delhi. Author’s area of interest includes Intellectual Property Rights, Jurisprudence and Interpretation of Statutes. The author has been on the Editorial Board of National Capital Law Journal and has authored various articles in journals and contributed chapters in books. She has also edited a book titled “Intellectual Property Rights: Contemporary Developments” published by Thomson Reuters.
