Title	Data Governance for Sustainability and Justice: Cross-Border Data Flows, Digital Public Goods, and Administrative Law Reform in Japan
Abstract	The rapid digital transformation across Asia has prompted a profound reconfiguration of legal and institutional frameworks governing cross-border data flows, personal data protection, and the utilisation of data and AI in public administration. This presentation explores these developments by examining Japan’s recent institutional responses, including the legal positioning of public data as digital public goods, the evolving role of the Personal Information Protection Commission (PPC), the enactment of the AI Promotion Act, the administrative guidelines on AI utilisation, and broader initiatives on open government data. Japan’s approach seeks to conceptualise data not only as an economic asset but also as a public resource, thereby aiming to enhance transparency, fairness, and inclusiveness in administrative governance. Moreover, Japan’s frameworks for public-private data collaboration and cross-border data transfer provide a potential model for sustainable digital governance. This presentation further examines the potential for constructing a pluralistic and stable data governance regime in Asia, while also highlighting Japan’s international initiatives and engagements. It considers the prospects for establishing common principles and interoperability mechanisms, and evaluates how Japan’s institutional experiences may inform the articulation of normative frameworks within the region. In doing so, it also reflects critically on both the opportunities and limitations of Japan’s role in contributing to a regionally integrated governance model.
Biography	Mayu Terada holds a LL.D. in Law from Hitotsubashi University, and J.D. from Keio University Law School, where she specialized in administrative law and information law. After serving as an Associate Professor at the International Christian University, she is currently a Professor at the Graduate School of Social Data Science, Hitotsubashi University. She has held various public roles, including Chair of the Saitama Prefecture Personal Information Protection Review Board, Member of the Tokyo Metropolitan Government’s Information Disclosure and Personal Information Protection Review Board, and Member of the Kanagawa Prefecture Information Disclosure Council. In addition, she has served on several national committees, such as the Cabinet Office, Cabinet Secretariat, and Cabinet Legislation Bureau Tender Monitoring Committee. Currently, she is a Member of the Ministry of Internal Affairs and Communications’ Council on Information Disclosure and Personal Information Protection, appointed by the National Diet.
