Implications of the good faith Principle for the South China Sea issue
Abstract
The establishment of a confidence mechanism will not only guarantee security and freedom of navigation in the South China Sea region, but also eliminate mutual suspicion among the countries involved in the South China Sea issue.The absence of a confidence mechanism will make it difficult to resolve the South China Sea issues (such as the construction of artificial islands and reefs and the protection of the marine environment, cooperation in the South China Sea, the South China Sea break line, and the consultation and negotiation of the Code of Conduct in the South China Sea, etc.).However, good faith is essential for the establishment of a trust mechanism, and good faith, as a general legal principle, has been widely recognized in international law and the jurisprudence of the International Court of Justice (ICJ). Therefore, the principle of good faith has a revealing effect on the resolution of the South China Sea issue, and the application of the principle of good faith and the establishment of the confidence mechanism will be the issues to be resolved in the future direction of the South China Sea issue.
Biography
Associate Researcher at the Law School of Guangdong University of Finance and Economics, Doctor of Laws, graduated from the Institute of International Law of Wuhan University in 2015, and was an associate researcher at the Law School of Sun Yat-sen University. My research areas are: fundamentals of public international law, law of the sea.
