Ethical and Legal Challenges of Artificial Intelligence in Criminal Law: Ensuring Fairness and Accountability
Abstract
This paper examines the application of Artificial Intelligence (AI) in the field of criminal law and the ethical and legal challenges it presents. As AI technologies are increasingly deployed in areas such as sentencing recommendations, offender risk assessments, and case predictions, understanding their impact on the criminal justice system becomes critically important. The study aims to investigate how AI is practically applied in these areas and explore the associated moral risks and legal responsibility issues. Specifically, we analyze the potential impact of data bias and algorithmic bias on judicial fairness, the issue of responsibility attribution in AI decision-making, and how to maintain transparency and fairness in AI-driven legal decisions. Through this research, we seek to provide a theoretical framework and practical recommendations to ensure the fairness of AI decisions, contributing to the responsible development of AI applications in criminal law.
