Abstract
Name of presenter: LiXiaolan Title of the paper: Evolution and Implications of American Data Policies: A Chinese Perspective Category: International Law Abstract: In recent years, the United States has frequently passed a number of executive orders and bills related to cross-border data flows, which are designed to protect individual privacy and national security. These orders and bills show the evolution characteristics from software prohibited to data transmission restrictions, also from -specific APP legislation to comprehensive legislation and from protective legislation to strategic legislation. They will directly affect the legalization of the operation and investment of enterprises in relevant countries (such as China) in the United States, at the same time they exacerbate the tension of the policy game caused by digital confrontation, and eventually affect the legislative coordination between countries as well as the global governance of cross-border data flow and the formulation of trade rules. From a Chinese perspective, in order to effectively respond to legislative trends in the United States, on the one hang, it is necessary to actively identify and respond to risks caused by changes in extraterritorial policies, also explore technical solutions that meet most of the data transmission requirements and expand the strategy of diversified global markets.On the other hand, it is equally important to connect with high-standard international economic and trade rules and disseminate Chinese technology and experience in the field of data governance, last but not least, to lead and innovate the construction of a new international rule system.
Biography
Li Xiaolan, a Ph.D candidate of East China University of Political Science and Law, whose research interests are international economic law and data law. Last few years, I participated in subject competitions such as Moot, Debate Competition, Challenge Cup, Internet +, NECCS, etc. I presided over a graduate research innovation project in Hunan Province in 2023 and participated in a national project about EU laws in 2024, also learn from many national academic conferences. For language and academic presentation experiences, I translated several academic articles in English and alway do presentations in meetings.
