Global Approaches to Cryptocurrency Regulation: India's Contribution
Abstract
The surge of cryptocurrencies has introduced profound shifts in the global financial landscape, challenging traditional regulatory systems and forcing a reevaluation of existing norms. The need for coordinated efforts in regulating cryptocurrencies arises from several key factors, particularly their decentralized and borderless nature, which introduces regulatory challenges that extend beyond individual national jurisdictions. Cryptocurrencies operate globally, making cross-border transactions common and difficult for any single country to control effectively. This unique feature complicates regulatory oversight, requiring international collaboration to address the potential risks and ensure comprehensive regulation that spans multiple jurisdictions. There is a noticeable lack of alignment in the regulatory approaches adopted by different nations, with each jurisdiction enforcing its own rules governing cryptocurrencies. This disparity can lead to regulatory arbitrage and inconsistencies in how crypto assets are treated globally. The global regulatory environment remains fragmented and lacking in uniformity, complicating efforts to establish cohesive oversight of the cryptocurrency market. As the market continues to grow and evolve, the demand for effective regulation becomes increasingly urgent. There is widespread recognition within the international community of the need for joint efforts to regulate cryptocurrencies. The G20, under India’s presidency, has underscored the growing significance of cryptocurrencies and stressed international cooperation. But, achieving a unified global regulatory framework remains a complex and ongoing challenge. Thus, this paper would venture into the existing global regulatory status of cryptocurrencies and further explore the role played by India as forerunner in promoting international co-operation in this evolving landscape.
Biography
Kiruthika Dhanapal currently holds the position as an Assistant Professor of Law at Chennai Dr.Ambedkar Government Law College Pudupakkam. She obtained her B.A.,B.L. (Hons.) degree from School of Excellence in Law, P.G.D.I.P.L. from Tamil Nadu Dr.Ambedkar Law University and LL.M. in Business Law from Chennai Dr.Ambedkar Government Law College, Chennai. She completed her M.A. in Public Administration from University of Madras (Distance Education). She is currently pursing her Ph.D. at the VIT School of Law, VIT University, Chennai. She is a Member of the Tamil Nadu State Moot Court Committee for the Academic year 2024-25 and also served as a Member for the Academic year 2022-23. She is a Member of the LL.M. Admission Committee of the Directorate of Legal Studies since the Academic Year 2022-23. She is one of the Contributors and Co-Investigator of the Project titled Police System India Series- Tamil Nadu Police. Before joining the Government Law College through the Teachers Recruitment Board of Tamil Nadu, she served as Assistant Professor at VIT School of Law, VIT, Chennai. Enrolled as an Advocate with the Bar Council of Tamil Nadu and Puducherry and practiced before the Hon’ble High Court of Madras between 2016 to 2018. Served as Legal Advisor to the reputed law firm named Vakilsearch and many other law firms during her practice. As a Law student was a Judicial Law Assistant under Dr. Justice S. Vimala, then Sitting Judge of Madras High Court and did internships at the State Human Rights Commission, Tamil Nadu, Chennai; the National Human Rights Commission, New Delhi, and awarded with the 2nd Best Intern of India Award. She was awarded Grade A+ at the prestigious Prof. N.R. Madhava Menon Workshop on Teaching Techniques and Research for Young Law Teachers and Research Scholars organised by the Indian Law Institute, New Delhi in 2019 and adjudged as the Best Participant of the 15 days Online Refresher Course for Law Faculties and Research Scholars organized by Iswar Saran PG College, University of Allahabad, Prayagraj in 2020 and also adjudged as the Best Performer in the UGC-FDP conducted in June, 2024. She has delivered various lectures as Resource Persons, Keynote Speaker, Chairperson, etc at several institutions and judged various prestigious International Moot Court Competitions like Philip Jessup, William Vis Moot, FDI Arbitration Moot, etc and National Moots like Prof. N.R. Madhava Memon SAARC Round of Moot Court Competition, etc. She has been a Co-Convenor for over a dozen Conferences/Seminars/Moot Court Competitions at National Level and State Level. She has presented Research papers at 52 Seminars and Conferences at International and National level including 20th & 21st Asian Law Institute Conference, Singapore and Bangkok and has own several best paper awards. She authored 43 Legal Research articles which are published by various reputed UGC Care Listed and Scopus Indexed journals and publications. She is acknowledged for her legal research contribution both at International and National level. She is also the author of the Book titled “Anthology of my Musings on LAW”.
