Title
Asia's role in the field of international law on cyber counter-terrorism
Abstract
Cyberspace is a global and dynamic domain, cyber terrorism is one of the most important non-traditional security issues facing the world. Asia is an important player in the field of international cyber counter-terrorism. Strengthening legal cooperation on cyber counter-terrorism among Asian countries is not only a need to safeguard cybersecurity in the Asian region but also a need for the international rule of law. Through international law, several cooperation mechanisms have been established, such as the “China - ASEAN Cyber Dialogue Mechanism” and the Shanghai Cooperation Organization (SCO) Cyber Security Cooperation Mechanism. The varying degrees of cyber counter-terrorism legislation in Asian countries highlights the huge potential for cooperation in the field of cyber counter-terrorism in Asia. The advanced countries in Asian cyber counter-terrorism legislation can provide advanced legislative experience, while the relatively backward countries can promote the improvement of their own cyber counter-terrorism legislation through the improvement of infrastructure. In Asian regional cooperation, China will play a more active role and provide new impetus to Asian legal cooperation on cyber counter-terrorism. In the future, Asian countries should further strengthen cooperation at the legal level, enhance the docking of legal rules on cyber counter-terrorism through bilateral and multilateral treaties, and establish an effective emergency response mechanism and a coordinated investigation mechanism on cybersecurity based on the law, to jointly deal with the threat of cyber-terrorism. Through cooperation among Asian countries, international legislation on cyber counter-terrorism should be promoted, and global cybersecurity governance will be pushed forward in a more just and reasonable direction.
Biography
Dr. Yang Kai is a assistant professor at School of International Law, China University of Political Science and Law (CUPL). He obtained his Ph.D. (2018) and LLM (2013) in International Law from Wuhan University. Prior joining CUPL in 2020, he served as the post-doctoral fellow at the Institute of European Studies of the Chinese Academy of Social Sciences (2018-2020). Specializing in cybersecurity law and international law, he has published a number of articles in peer-reviewed journals and edited volumes on those topics, i.e., Chinese Law Review, Chinese Journal of European Law Review.
