Under the Paradigm of Domain Legislation: Exploring the Legal Governance of Bioterrorism in China.
Abstract
The issue of bioterrorism in a risk society is gradually exhibiting characteristics such as domain-specificity, complexity, and intersectionality, posing increasingly severe threats to human survival and national security. Based on the need for modernization of national governance, domain legislation has become an important legal regulatory paradigm for bioterrorism issues. It focuses on key risk issues in the field of bioterrorism, takes into account various legal resources, and has initially established a legal system in the field of bioterrorism. It also combines domestic rule of law with foreign-related rule of law, striving to achieve a coordinated realization of domestic security and global governance. Under the examination of systematic, comprehensive, and open thinking in domain law, it is found that the coupling structure of China's anti-bioterrorism criminal and executive legislation has not yet been formed, local legislation urgently needs to be improved, there is a lack of legislative response to cyber bioterrorism, and the capacity to participate in international governance of biosecurity is still limited. Therefore, it is necessary to deeply apply the domain legislative paradigm, comprehensively layout under the overall concept of national security, coordinate internal and external aspects, achieve the transformation from policy-based governance to rule of law governance, and pave a path for bioterrorism legal governance in response to Chinese-style modernization.
Biography
I am Yan Ge, a Ph.D. candidate in International Law at Beijing Normal University and a member of the International Criminal Law Association. My research interests include international public law and national security. I have published papers such as On the Application of Precautionary Principle to Preventive Counter-terrorism, Research on Conflicts Regarding the Exercise of Universal Jurisdiction by States over Crimes Against Humanity,The Inner Logic and Future Research of China's Anti Biological Terrorism Legislation,and The Application Scenarios and Prospects of Blockchain Technology in Empowering Justice. I have also interned at the International Cooperation Bureau of the Supreme People's Procuratorate.
