Research on the Inheritance and Application of Rule of Law Culture in Judicial Cases of the Chinese Legal System -- Also on Legal Interpretation in Traditional Justice
Abstract
Abstract: As a unique legal tradition of the Chinese nation, the Chinese legal system has not only profoundly influenced the legal system construction in Chinese history, but also holds an important position in the global legal civilization. As a core component of the Chinese legal system, the inheritance and development of the rule of law culture have significant implications for the construction of modern rule of law. The Chinese legal system has a long history, and the rule of law culture it contains is an important part of China's fine traditional culture. The judicial cases of the Chinese legal system are rich in the inheritance of the rule of law culture. During the long process of historical evolution, these rule of law cultures have been fully reflected in judicial cases and have played an important role in social governance. This article takes the culture of the rule of law as the entry point to explore its manifestation and application in judicial cases of the Chinese legal system. Through the analysis of typical cases, the specific application of the rule of law culture in judicial practice and its contribution to social governance are revealed. On this basis, the article further considers how to draw on the judicial interpretation of traditional legal interpretation theories to provide beneficial inspirations for the construction of modern rule of law.
Biography
Personal resume Zhao Bing, male, born in Jinan City, Shandong Province, is now a first-level judge of the People's Court of Huaiyin District in Jinan. His research direction covers legal sociology and judicial management, etc. He is a member of the World Jurist Association, the China Legal History Society, the National Foreign Legal History Research Association, the Legalist Research Association of the Pre-Qin History Society of China, the Jurisprudence Research Association of the China Law Society, and the Professional Committee of the History of Chinese Legal Thoughts. Good foreign language proficiency, has passed CET4, CET6, PETS4, CPA National unified examination English test and obtained the certificate. He received his Bachelor's degree in Law from Yantai University in 2003 and his master's degree in law from Shandong University in 2006. His research direction was maritime rights disputes. He also received his master's degree in Public administration from Qingdao University in 2015, and his research direction was human resource development and management in public sector. In the more than 20 years of work practice engaged in judicial organs, he has constantly studied, thought, researched and written in his spare time, and has benefited a lot from theoretical discussion and contention with colleagues in the academic field through various ways. In the past 10 years, he has published more than 20 papers on legal theory, judicial management and reform, and legal culture in journals above the provincial level. During this period, he has participated in a number of international and domestic academic conferences and made keynote speeches or provided written reports, won a number of provincial and ministerial awards and municipal awards, and participated in a national project. One article has been published in the central media newspaper Democracy and Legal Times, one article has been included in the academic monograph Judicial Studies 2022 published by People's Publishing House, and five articles have been published on the Philosophy and Social Sciences Preprint Platform (PSSXiv). In particular, he has a more in-depth thinking and summary of legalist thought and social governance, international cooperation development and sovereignty management, judicial system reform and judge professionalism.
