Title	From Fragmentation to Integration: Rethinking Labour and Employment Law for Asia’s Sustainable Future
Abstract	Asia’s rapid economic rise has not been matched by coherent labour and employment law development. Instead, the region faces a fragmented legal landscape, with disparities in wage systems, social security schemes, and protections for vulnerable groups such as migrant laborers and digital platform workers. This fragmentation weakens workers’ rights, fuels unfair competition through “race to the bottom” practices, and undermines the broader vision of sustainability, justice, and integration in Asia. This paper examines the scope and impact of labour and employment law fragmentation across Asian countries and its consequences for regional economic and social stability. It highlights how divergent legal frameworks shape workers' treatment, particularly in cross-border migration and gig work. It situates these dynamics within global debates on decent work and sustainable development. Comparative insights are drawn from the European Union’s minimum labor standards and the North American model of labour protection, offering lessons for Asia’s path toward convergence. The paper’s contribution lies in proposing a “hybrid harmonization model” that blends soft law approaches—such as regional declarations and voluntary guidelines—with gradual hard law commitments, including conventions and enforceable regional standards. This model respects the diversity of Asia’s legal systems and varying economic capacities, while charting a realistic pathway toward regional alignment. By linking national reforms with regional governance, the paper reframes labor law as a mechanism of worker protection and a pillar of sustainable integration. The conclusion argues that overcoming fragmentation is a strategic imperative for Asia’s future. Establishing minimum regional standards for worker protection will safeguard justice at work, prevent destructive competition among states, and ensure that Asia’s economic rise remains inclusive, sustainable, and aligned with global commitments to social justice.
Biography	Nindry Sulistya Widiastiani is a Lecturer at the Faculty of Law, Universitas Atma Jaya Yogyakarta, where she has served since 2017 and currently holds the academic rank of Lektor (Assistant Professor). She earned her Bachelor of Law (S.H.) and Master of Law (M.H.) degrees from Universitas Gadjah Mada, specializing in labour and employment law. She is also a Certified Industrial Relations Practitioner (CIRP) accredited by the Indonesian National Professional Certification Agency (BNSP). Her academic interests focus on labour and employment law, industrial relations, and the challenges of digital transformation in the workplace. She has authored several books, including Pengantar Hukum Perburuhan: Pasca Undang-Undang Cipta Kerja (Kanisius, 2022). In addition, she has published numerous articles in national and international journals on topics ranging from workers’ rights and trade unions to gender equality, digital workplace policies, and social protection. Beyond teaching and research, Nindry plays an active role in academic publishing. She previously served as Managing Editor of Jurnal Justitia Et Pax (2019–2024) and is currently Editor in Chief of both Jurnal Justitia Et Pax and Jurnal Domus Legalis Cogitatio. She is also frequently invited as a speaker in seminars, workshops, and media discussions on labor law and public policy. Her work reflects a strong commitment to advancing progressive labour law scholarship and promoting better protection for workers in Indonesia’s evolving employment landscape.
