Title	Key Challenges in Balancing Legal Compliance and Family Expectations in the Management of Testamentary Trusts in Malaysia
Abstract	Testamentary trusts are critical instruments in estate planning, allowing individuals to direct how their assets are distributed after their death. In Malaysia, however, the management of these trusts is complicated by the need to adhere to multiple legal frameworks, particularly the Trustee Act 1949 and the Wills Act 1959. The combination of these two statutes often creates confusion and difficulty in balancing legal requirements with the expectations of family members. While testamentary trusts offer flexibility and control over asset distribution, the process of administering them can be challenging due to the complex legal compliance involved. Trustees, who are often family members with limited legal or financial expertise, may find it difficult to navigate the intricacies of the law, leading to mismanagement or delays in asset distribution. Additionally, beneficiaries may have unrealistic expectations or misunderstandings about the terms of the trust, which can further complicate matters. This paper examines the broader issues surrounding the administration of testamentary trusts in Malaysia, particularly the tension between ensuring compliance with legal statutes and addressing the expectations and dynamics within families. By utilizing library-based research, the study explores how the conflicting demands of legal frameworks and family relationships can hinder the effective management of testamentary trusts. The findings highlight the importance of clearer communication, trustee education, and improved awareness among beneficiaries to ensure that testamentary trusts function smoothly, in accordance with the testator’s intentions.
Biography	Muhammad Amrullah bin Drs Nasrul is an Assistant Professor at the Ahmad Ibrahim Kulliyyah of Laws, International Islamic University Malaysia (IIUM), where he has been serving since 2020. He holds a Doctor of Philosophy in Law from IIUM, obtained in 2018, and a Master of Comparative Laws from the same institution, completed in 2010. He also earned his Bachelor of Laws (Hons.) in 2007 from IIUM. Prior to his academic career at IIUM, Dr. Amrullah held various roles, including Senior Lecturer at Universiti Malaya and Lecturer at Kolej Universiti Islam Antarabangsa Selangor, where he taught courses such as the Law of Contract, Criminal Law, and the Law of Trust. His professional background also includes legal practice as a Legal Executive and Deputy Public Prosecutor, which enriched his academic perspective on law and estate management. Dr. Amrullah’s research interests focus on estate administration, particularly in the harmonization of Shari'ah and civil law in Malaysia, with a specific focus on inheritance, trust law, and dispute resolution mechanisms. His work also explores the integration of Islamic principles with contemporary legal systems, including comparative studies of inheritance laws in Malaysia and Indonesia. He has received multiple research grants and has contributed to various publications, including articles and book chapters, on topics such as waqf law, family dispute resolution, and the legal complexities of estate administration. His ongoing research projects include developing mediation frameworks for estate administration and analyzing digital assets in inheritance management.
