Implementing Data Protection by Design and Legal Accountability of Vietnamese Enterprises in Personal Data Processing
Abstract
In the context of rapid digital transformation, the protection of personal data has become a critical requirement for enterprises to safeguard individual privacy and ensure information security. This study examines the implementation of the Privacy by Design principle within Vietnamese enterprises, focusing on their legal accountability when processing personal data. Grounded in both international frameworks such as the European General Data Protection Regulation (GDPR) and Vietnam’s Personal Data Protection Law along with Decree 13/2023/ND-CP, the research analyzes the current compliance status and challenges faced by Vietnamese businesses. Key obstacles include the high cost of implementation, lack of specific technical guidelines, and variability in the scale and complexity of data processing activities. Based on these insights, the study proposes practical recommendations for improving the legal framework, enhancing organizational capacity, and promoting effective integration of Privacy by Design. These measures aim to strengthen personal data protection, uphold corporate responsibility, and support sustainable digital economic growth in Vietnam.
Biography
Nguyen Thi Long is a Senior Lecturer in Civil Law at Hanoi Law University, with more than ten years of experience in teaching and research. She teaches subjects such as Contract Law, Inheritance Law, and Privacy Law, demonstrating extensive expertise in civil law. Beyond her academic work, Ms. Long has actively participated in providing legal consultation, feedback, and dissemination for various agencies under the Ministry of Justice, including the Department of State Compensation and the Department of Registration of Secured Transactions. She has contributed expert opinions to the drafting of major legislative instruments such as the 2015 Civil Code, the Law on Protection of Consumer Rights, the Law on Electronic Transactions, and the Law on Medical Examination and Treatment..
