Title
The Application of Artificial Intelligence in International Arbitration and Its Legal Boundaries
Abstract
This article aims to systematically explore the current application status, legal challenges, and future regulatory paths of artificial intelligence technology in the field of international commercial arbitration. With the explosive development of generative AI such as ChatGPT and Deepseek, AI is increasingly penetrating arbitration procedures, from legal research, document translation, evidence analysis, and even adjudication assistance, reshaping traditional arbitration models. From a comparative law perspective, this article will analyze the soft law guidance on AI applications by major arbitration institutions, combined with the intelligent practices of international and China's arbitration institutions, to explore how to build an AI arbitration governance framework that balances efficiency and fairness, providing China's wisdom for the modernization of global arbitration. The article emphasizes that the application of artificial intelligence in international arbitration should establish its legal boundaries based on the nature and classification of tasks. Specifically, it advocates for proactive use of AI to handle procedural or mechanical tasks, moderate use for auxiliary purposes, and strict prohibition of AI replacing arbitrators in decision-making. Furthermore, fundamental principles for AI application in international arbitration should be established, including: respecting parties 'autonomy and specific national mandatory rules; disclosing AI usage obligations; strengthening confidentiality obligations in arbitration; ensuring diligence in reviewing by both arbitral tribunals and parties; and safeguarding the tribunal's authority to rule on AI-assisted decisions.
Biography
Dr. Li Jing is an Associate Professor at International Law School of East China University of Political Science and Law. She graduated from the Law School of Wuhan University and received her doctor degree. She studied in the Hague Academy of International Law in the year of 2005 and 2009. In 2015, she visited Macquarie University in Australia for legal teaching methodology training. In 2019,she attended a training program of arbitration in London. In 2025,she gave lectures on Chinese Arbitration Law at Jagiellonian University in Poland. Dr. Li Jing is a member of Chinese Academy on Private International Law and Chinese Institute of International Law. Her research focuses on the areas of Conflict of Laws, International Commercial Arbitration and Civil Litigation Law. Her most recent articles have dealt with the civil jurisdiction in Chinese Civil Procedure law and International commercial Arbitration.
