Protecting Vulnerable Groups in Vietnam through the Civil Litigation Mechanism of the People’s Procuracy – Current Situation and Prospects
Abstract
On June 24, 2025, the National Assembly of Vietnam adopted Resolution No. 205/2025/QH15, introducing a pilot mechanism that authorizes the People’s Procuracy to initiate civil lawsuits in order to protect the civil rights of vulnerable groups or public interests. This regulation marks a new stage in the development of the socialist rule-of-law state and in the improvement of mechanisms for the protection and promotion of human rights in Vietnam. The paper focuses on analyzing the legal and policy implications of this pilot mechanism in enhancing access to justice for individuals or groups who are unable to defend their civil rights on their own. Based on an analysis of current Vietnamese law, international experiences regarding the standing of public authorities to initiate lawsuits, and theoretical frameworks on the protection of vulnerable groups, the paper assesses the potential impacts of this new mechanism on ensuring social justice and strengthening the role of the People’s Procuracy in safeguarding justice. Drawing on these analyses, the author proposes several recommendations to ensure the effective implementation of the pilot scheme, thereby contributing to reinforcing the role of the People’s Procuracy in protecting justice and the rights of vulnerable groups in contemporary Vietnamese society.
Biography
Dr. Hoàng Thị Lan Phương has been a Lecturer at the Faculty of Administrative and State Law, Hanoi Law University, for ten years. Her main research interests include human rights, citizens’ rights, and administrative reform. She is the author of the book “The Right to Denounce under Vietnamese Law” (published in 2025 by the People’s Public Security Publishing House) and several other scholarly articles.
