Title
Inclusive and Responsive Legal Framework to Safeguard Women’s Rights in the Digital Age
Abstract
Abstract: The rise of technology has revolutionized communication and intensified gender-based violence using social media. Across Asia, women face exposure to online harassment due to the misuse of Artificial Intelligence, a tool founded for efficiency, resulting in a weapon that creates improper media about victims. Various studies provide key data points for the Asia-Pacific region. The UN Women report reveals that 60% of women internet users in the Arab States have experienced online violence. In the Philippines, 7 out of 10 girls and young women reported online harassment, while 85% of women in South Korea encountered online hate speech. During COVID-19 lockdowns, misogynistic online posts increased by 168% in India, Sri Lanka, and Malaysia, and women in Singapore were nearly twice as likely as men to face online sexual harassment. Perpetrators threaten victims by tracking their location, doxxing their information, and even creating improper media. This research explores the intersection of women and law in the realm of digitalization and its impact. The methodology used is normative legal research, followed by case studies used to compare policies, security forces' response, and legal frameworks across Asian jurisdictions. The mixed method aims to identify the lack of enforcement that hinders justice for women facing digital sexual exploitation and to document their experiences and discomfort in reporting such cases. As the solution, this research proposes the creation of a legal foundation dedicated to supporting victims of sexual abuse through an online platform. This study promotes an inclusive and responsive legal framework that safeguards women’s rights and autonomy in the digital age.
Biography
Susi Susantijo started her law career as an in-house lawyer and Corporate Secretary in a multinational group of companies. She earned her Bachelor of Law (SH) from the Faculty of Law - Universitas Sumatera Utara (USU); Master of Law (LL.M) from Murdoch University - Australia and Doctor of Law from Universitas Pelita Harapan (UPH). She joins UPH since 2004, she was the Director of Administration to UPH Law Faculty and started her route in academia teaching Civil Law, Commercial Law, and Law & Human Rights. Currently, she was entrusted to serve as Department Chair of Master of Public Notary at UPH Graduate School.
