Advanced Torts

Course Description:
This course is designed to build on and further your knowledge of tort law and theory. It is divided into two main parts.
In Part One, we will re-familiarise you with tort law and examine torts /topics not covered in the first year course. This will include consideration of important torts based on intentional wrongdoing (deceit and conspiracy) and those of 'stricter liability' (defamation, trespass to goods and conversion). These torts will be examined by reference to the best of the literature and a selection of representative cases.
In Part Two, we will step back from doctrinal detail and examine fundamental concepts and debates in tort law. The objective is to understand what is distinctive about tort law and how it might be theorised. Topics studied are likely to include corrective justice/rights-based theories, instrumentalist theories and tort law-and-regulation. Please note that this part of the course is reflective in nature and not simply a continuation of prior studies. The advantage is that it opens up a new language of private law which is portable across jurisdictional divides.
