Comparative Constitutional Law

Course Description:
At present there is an unprecedented and ongoing world-wide conversation about how to resolve contentious constitutional questions. There is, consequently, more convergence over answers to constitutional questions and less divergence than we have seen in modern times. A part of that conversation concerns which precedents, issuing out of which jurisdictions, provide models for judicial decision making and which other precedents should be strenuously avoided. This course examines the content of what is called the canons of comparative constitutional law. Of interest will be cases that serve not only as models of constitutional analysis but also as anti-models. We will be guided by essays authored by a diverse set of constitutional scholars, addressing a variety of topics, in addition to a selection of the precedents that they have nominated as canons of comparative constitutional law. Among the topics for discussion will be equality, fundamental freedoms, property rights, proportionality analysis, social rights, and the separation of powers. In addition, selected regional approaches and historic moments that inform contemporary constitutional debates are examined.

Preclusions: (1) Students who have taken or are taking LL4304/LL5304/LL6304; LL4304V/LL5304V/LL6304V Global Comparative Constitutional Law; LL4369/LL5369/LL6369 Constitutionalism in Asia; LL4368/LL5368/LL6368 Comparative Constitutionalism are precluded. (2) Students who have done Comparative Constitutional Law [Module code: L55.3027] under the NYU@NUS Summer Session are precluded.
Prerequisites: NUS Compulsory Core Law Curriculum or equivalent.
