Contract Theory

Course Description:
This course adopts a theoretical approach to explaining contract formation and the normative structure of contractual relations, while situating theories of contract within broader philosophical debates about private law and undertaking obligations in the private sphere. While critically examining the idea of correlativity of rights and duties and focusing on normative powers, the course tests different accounts of how contractual obligations are undertaken by drawing on the Hohfeldian analysis of legal relations and on the relevant studies in deontic logic. Students will be given an opportunity to write a research paper on a topic of particular interest to them.
